Terms of Service
These Terms of Service ("Terms") govern your access to and use of ListenBrief ("the Service"). The Service is operated by Zamforge BV (a private limited company registered in the Netherlands under VAT number NL869600825B01, "we", "us", "our") under the brand name ListenBrief. By creating an account or using the Service, you agree to these Terms.
1. Service description
ListenBrief is a personalized audio briefing platform. You provide topics, sources (RSS feeds, YouTube channels, newsletters, websites), and preferences; our systems generate a short AI-written script from those sources, synthesize it to MP3 using a neural text-to-speech engine, and deliver it to you on a schedule you choose.
You are responsible for the sources you add and for the legality of accessing them in your jurisdiction.
2. Accounts
You must provide a valid email address to use the Service. You are responsible for keeping your credentials secure and for activity on your account. Notify us promptly at hermes@zamforge.shop if you suspect unauthorized access.
3. Subscriptions, payment, and cancellation
Paid plans are billed monthly in advance by Zamforge BV (Netherlands, VAT NL869600825B01) through our payment processor, Stripe. The name that appears on your credit card or bank statement is Zamforge BV. All prices are listed in EUR (€) and apply VAT based on your country of residence; the applicable VAT amount is shown at checkout before you confirm payment.
The first 7 days of any new paid plan are a free trial. You can cancel during the trial at no charge. If you do not cancel, the plan converts to a paid monthly subscription on day 8.
You may cancel at any time from Settings → Billing; your access continues until the end of the billing period already paid for. We do not provide partial refunds for the remainder of a billing period.
Prices may change for future billing cycles; we will give you at least 30 days' notice by email before any change applies to your subscription.
4. Acceptable use
You agree not to:
- Use the Service to generate, distribute, or promote content that is unlawful, infringing, defamatory, harassing, or deceptive.
- Attempt to reverse-engineer, scrape, or otherwise extract our source code, models, prompts, or generated briefings at scale.
- Interfere with the Service, including by introducing automated traffic at a rate that exceeds normal human use.
- Use the Service to train competing models or systems.
We may suspend or terminate accounts that violate this section.
5. Your content and your data
You retain ownership of the content you submit (topics, sources, notes). You grant us a limited, non-exclusive license to use that content to operate the Service for you — including fetching your sources, generating the briefing, synthesizing the audio, and delivering it to you.
Generated briefings are derivative works created for your personal use. You may share individual briefings you receive from us.
6. Intellectual property
The Service, including its software, design, branding, prompts, and underlying systems, is owned by us and protected by intellectual property laws. Nothing in these Terms transfers ownership of our IP to you.
7. Third-party services
The Service integrates with third parties to function, including: Stripe (payment processing), OpenRouter (language model inference), a self-hosted text-to-speech microservice, Google (email delivery), and Cloudflare (hosting and storage). Your use of those services is also subject to their terms. We are not responsible for outages or policy changes at those providers.
8. Disclaimers
The Service is provided "as is" and "as available". We do our best to make briefings accurate, but AI-generated content can be wrong. Briefings may contain errors, omissions, or material that becomes outdated. Verify before acting on anything in a briefing, especially for financial, medical, legal, or other high-stakes decisions.
We do not guarantee uninterrupted delivery, and we are not responsible for failures caused by your email provider, DNS, or network.
9. Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim arising out of or related to the Service is limited to the amount you paid us in the 12 months immediately preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
10. Termination
You may terminate at any time by canceling your subscription and requesting account deletion. We may suspend or terminate the Service or your access if you breach these Terms, if payment fails, or if we discontinue the Service. Where reasonable, we will give advance notice.
11. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will notify you by email at least 14 days before it takes effect. Continued use of the Service after the effective date constitutes acceptance.
12. Governing law and disputes
These Terms are governed by the laws of the Netherlands. Any dispute will be resolved in the competent courts of Amsterdam, the Netherlands, unless mandatory consumer protection law in your country gives you the right to bring a claim locally.
